Data Compensation Claims

Many new applicants for pesticide registration do not realize that under certain circumstances they may cite data previously submitted by others in support of their present applications. Delta staff have aided clients in identifying relevant data, filing appropriate paperwork with EPA for citing and compensating the previous data submitter, and, in contested circumstances, preparing for arbitration under the auspices of the American Arbitration Association.

Delta has considerable experience assessing data compensation liability, negotiating appropriate compensation, and assisting its clients in arbitration proceedings. In addition, we offer services to data submitters in organizing documentation of data development costs and pursuing compensation through negotiation and arbitration.
